Welcome to Qol, operated by Qol Inc, a Delaware corporation ("Qol", "we", "our", or "us"). These Terms of Service (Terms) govern your use of Qol's website, mobile applications, and related services (the "Service"). By using Qol, you agree to these Terms.
1. Who We Are
Qol is an AI-powered language tutor designed to help users improve speaking confidence and real-world conversation skills. For questions, contact support@useqol.com.
2. Eligibility
You must be at least 13 years old to use Qol. By using the Service, you confirm that you can form a legally binding contract and comply with these Terms and applicable laws. If you use Qol on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Acceptable Use
You agree not to misuse the Service. You must not:
- Access or attempt to access systems without authorization
- Use the Service for unlawful, harmful, abusive, or deceptive purposes
- Reverse engineer, copy, scrape, resell, or exploit Qol's software, models, prompts, audio, data, or infrastructure except as permitted by law
- Overload, disrupt, or abuse the Service, including attempts to bypass usage limits, billing controls, or security controls
- Submit content that violates the rights of others
- Use Qol to generate or distribute malware, harassment, or illegal content
We may suspend or terminate access for violations.
4. Accounts and Security
You agree to:
- Provide accurate account information
- Keep your credentials secure
- Notify us promptly of unauthorized access
- Use only your own account unless you have permission
You are responsible for activity under your account. Qol is not responsible for losses caused by your failure to protect your account credentials.
5. Subscriptions and Payments
Some features require a paid subscription. Payments may be processed via Stripe, RevenueCat, the Apple App Store, or Google Play. Subscriptions may automatically renew unless canceled.
You can manage or cancel subscriptions through your Qol account, Qol's web billing portal, the Apple App Store, or Google Play, depending on where you purchased the subscription. Cancellation generally takes effect at the end of the current billing period.
Except where required by law or stated in our Refund Policy, payments are non-refundable. App-store purchases are also subject to Apple's or Google's applicable terms, billing rules, and refund policies.
6. AI Features
Qol uses artificial intelligence to generate tutoring responses, feedback, scoring, transcripts, summaries, vocabulary suggestions, and language learning assistance.
AI-generated outputs may be inaccurate, incomplete, delayed, offensive, or inappropriate. You are responsible for evaluating outputs before relying on them.
The Service is provided for educational and practice purposes only and does not constitute professional, legal, medical, financial, or other regulated advice.
Qol does not guarantee specific learning outcomes, fluency, test results, pronunciation improvements, or other performance results.
By using voice features, you consent to Qol and its service providers processing your audio input, transcripts, session metadata, tutor replay audio, and learning data as described in our Privacy Policy.
7. User Content
You retain ownership of content you submit to Qol, including speech, audio, transcripts, text, settings, and support messages. You grant Qol a worldwide, non-exclusive, royalty-free license to host, process, transmit, reproduce, modify, create derived technical data from, and use your content as needed to operate, secure, personalize, analyze, and improve the Service.
You are responsible for your content and must not submit unlawful, harmful, infringing, private, or sensitive material unless you have the right to provide it and it is appropriate for language learning use.
8. Privacy and Data
Our Privacy Policy explains how Qol collects, uses, stores, and shares information, including account data, transcripts, audio, learning progress, analytics, crash diagnostics, and billing information. By using the Service, you agree that Qol may process information as described in that policy.
9. Intellectual Property
All rights to Qol's software, branding, designs, prompts, workflows, technology, and Service content belong to Qol Inc or its licensors. You may not copy, modify, distribute, sell, or use them except as allowed by these Terms or with our written permission.
10. Service Availability
We may modify, suspend, limit, or discontinue the Service or any feature at any time. We may also set or change usage limits, plan features, supported languages, or technical requirements.
Some features may be experimental and may change, produce unexpected results, or become unavailable without notice.
11. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Qol is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, learning outcomes, service interruptions, or security incidents outside Qol's reasonable control.
To the fullest extent permitted by law, Qol's total liability for any claim relating to the Service will not exceed the amount paid by you to Qol for the Service in the 12 months before the claim arose.
13. Termination
We may suspend or terminate your access if you violate these Terms, create risk for Qol or others, fail to pay amounts owed, or use the Service in a way that may cause legal, security, or operational harm.
You may stop using the Service at any time and delete your account within the app or website where supported. Deleting your account does not automatically cancel a subscription purchased through Apple, Google, or another third-party platform; you must cancel billing separately where required.
Certain provisions survive termination, including user content licenses needed for prior operation, intellectual property, disclaimers, liability limitations, payment obligations, and governing law.
14. Mobile Applications
If you use Qol through the Apple App Store or Google Play, those platforms are not responsible for the Service. Their terms, billing rules, refund policies, device permissions, and app-store requirements may also apply.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and may provide additional notice where appropriate. Continued use of the Service after changes become effective means you accept the updated Terms.
