Terms of Service

Welcome to Qol, operated by Qol Inc, a Delaware corporation (“Qol,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of Qol’s website, applications, and related services (collectively, the “Service”). By using Qol, you agree to these Terms. Please read them carefully.

1. Who We Are

Qol provides AI-powered language tutoring designed to help users improve pronunciation, speaking, and real-world conversation skills through voice-based interaction. If you have questions, contact us at support@useqol.com.

2. Eligibility

You must be at least 13 years old to use Qol. By using the Service, you confirm that you can form a legally binding contract, comply with these Terms, and comply with all applicable laws.

5. Subscriptions and Payments

Certain features of Qol may require a paid subscription. If you purchase a subscription, you authorize Qol to charge your payment method through Stripe or, where applicable, through the Apple App Store or Google Play. Subscriptions may automatically renew unless canceled before the renewal date.

You can manage or cancel your subscription through your account settings or through the platform from which you purchased the subscription. Subscriptions purchased through third-party platforms, including Apple App Store or Google Play, are subject to those platforms’ billing and refund policies.

6. AI Interaction

Qol uses artificial intelligence to generate tutoring responses, pronunciation feedback, and related language-learning features. AI-generated outputs may not always be accurate, complete, or appropriate. The Service is provided for educational purposes only and should not be relied upon as professional, legal, medical, or other expert advice.

By using Qol’s tutor, speech, or pronunciation features, you consent to the processing of your voice and related inputs as described in our Privacy Policy.

7. User Content

You retain ownership of the content you submit, upload, or speak while using the Service. However, you grant Qol a limited, non-exclusive license to host, process, transmit, and analyze that content as necessary to operate, maintain, improve, and provide the Service.

You are solely responsible for your content and agree not to submit content that is unlawful, abusive, defamatory, infringing, or otherwise violates the rights of others.

8. Intellectual Property

All rights, title, and interest in and to Qol, including our software, designs, branding, logos, content, and related technology, are owned by Qol Inc or its licensors. Except as expressly permitted by these Terms, you may not use, copy, modify, distribute, or create derivative works from Qol’s intellectual property without prior written consent.

9. Service Changes and Availability

We may update, enhance, suspend, or discontinue parts of the Service at any time. We do not guarantee uninterrupted, secure, or error-free operation, though we strive for high reliability and quality.

10. Disclaimer

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Qol disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Qol and its affiliates, officers, employees, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, revenue, business opportunities, or goodwill, arising from or related to your use of the Service.

In no event will Qol’s total liability for all claims arising out of or relating to the Service exceed the total amount you paid to Qol for the Service in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service. You may stop using the Service at any time and may request account deletion by contacting support@useqol.com.

Upon termination, provisions of these Terms that by their nature should survive termination will remain in effect, including those relating to intellectual property, disclaimers, limitation of liability, and governing law.

13. Mobile Applications

If you download or use Qol through the Apple App Store or Google Play, you acknowledge that these Terms are between you and Qol Inc, not with Apple or Google. Apple and Google are not responsible for the Service and have no obligation to provide maintenance, support, or warranty services for Qol.

You also agree to comply with all applicable third-party platform terms when using the mobile version of Qol.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

15. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on our website with a new effective date. Your continued use of Qol after the updated Terms take effect constitutes acceptance of the revised Terms.
